Summary of work

In November 2011, the OFT issued a statement of objections alleging that British Airways and Virgin Atlantic have infringed competition law (the Chapter I prohibition of the Competition Act 1998 and/or Article 101 of the Treaty on the Functioning of the European Union) in relation to fuel surcharges for long-haul passenger services to and from the UK between August 2004 and January 2006.

In August 2007, the OFT announced that it had reached an early resolution agreement with British Airways and that British Airways had agreed to pay a penalty of £121.5m. Virgin Atlantic is not expected to pay a penalty as it currently qualifies in principle for full immunity under the OFT's leniency policy.

The OFT will consider any representations that the parties submit in relation to the matters set out in the SO. Any penalty will only become payable following the issue of an Infringement Decision.
