Investigation into bid-rigging in the construction industry in England

Summary of work

The OFT has completed its investigation into bid-rigging in breach of the Chapter I prohibition of the Competition Act 1998 involving over 100 construction companies.

On 22 September the OFT announced its final decision imposing fines totalling £129.2 million on 103 construction firms found to have colluded with competitors in breach of the Chapter I prohibition.

Twenty five out of 103 have appealed the decision to the Competition Appeals Tribunal. All 25 appeals are against the penalty with six also challenging liability.
