The Rail Regulator has investigated a complaint made by the Sub Contractors Welding Federation, in a letter to him dated 7 July 2003, that Network Rail has infringed the Chapter II Prohibition of the 1998 Competition Act. The complaint concerned Network Rail's revised tendering arrangements for procuring rail welding services. The Regulator has concluded that even if it could be established that Network Rail holds a dominant position on any one or more relevant markets, he does not have reasonable grounds to suspect that Network Rail has infringed the Chapter II prohibition in this instance, by restricting the number of contractors from which it procures rail welding services.
