The Director General of Telecommunications has conducted an investigation examining whether Vodafone infringed the Chapter II prohibition of the Competition Act in relation to the disconnection of Floe Telecom's services.
Floe alleged that Vodafone periodically suspended Floe Telecom's GSM Gateway services on the grounds of unlawful activity, yet still permitted GSM Gateway services by others, including Vodafone's own service providers.
The Director has now completed his investigation. The Director has concluded that Floe Telecom had not been authorised by Vodafone to provide Public GSM Gateways, and that Vodafone therefore had an objective reason to refuse to supply Floe's Public GSM Gateway services. The Director has also concluded that Vodafone is not acting in a discriminatory manner in its treatment of Public GSM Gateway operators.
Therefore the Director does not consider that Vodafone's disconnection of Floe's services constitutes an infringement of the Competition Act.
