On 2 March 2011 the OFT published the final version of the Competition Act 1998 Procedures Guidance. The final version of the guidance reflects many of the comments provided during the consultation.
On the same day, the OFT announced a one-year trial of a Procedural Adjudicator role. The trial is being conducted in response to comments made to the OFT during the consultation on the draft procedures guidance. The purpose of the trial is to provide a swift, efficient and cost-effective mechanism for resolving disputes between parties and the case teams in respect of certain procedural matters.
This consultation concerned the OFT's proposal to introduce new guidance on how the OFT conducts investigations under the Competition Act 1998 (the Act). It was intended to give interested parties the opportunity to provide views and comments on the proposed new guidance. We recognise the importance of being open and clear about the procedures that we follow when undertaking investigations into anti-competitive practices. There is existing published guidance on the processes we follow in our investigations under the Act, and we have decided to update this guidance to reflect our current practice.
In May 2010 we engaged with a number of legal professional advisors to obtain feedback on their experiences of how the OFT conducts investigations under the Act, and to gain a better understanding of what type of information about the OFT's procedures they would find useful. Their views have informed the content of this document. We welcomed your views and comments (contact details below) on the consultation document.
