Summary

This consultation, issued by the Office of Fair Trading (OFT) and supported by the Local Better Regulation Office (LBRO), is on the Enforcement Approach to the Department for Business, Innovation and Skills (BIS) civil sanctions pilot (the Pilot) - for further information see: www.bis.gov.uk/Consultations/civil-sanctions-pilot.

The Pilot is on hold pending decisions by Ministers. The OFT will not be issuing a response until a decision about the Pilot is taken.

The Statutory Instruments (SIs) which would create the powers outlined in this Enforcement Approach were expected to be given force in February 2011, but have been put on hold. If the SIs are introduced the Enforcement Approach will be updated to reflect the powers contained within them and thus further consultation is likely to be necessary.

The Pilot powers were intended to be made available to the OFT and fourteen participating local authority Trading Standards Services (TSS).

This consultation describes:

  • the Pilot and the context in which it operates
  • the civil sanctions powers and their operation
  • application of the sanctions to the legislation included in the scope of the Pilot 
  • sources of further information on the sanctions and on the enforcement policies of the participating enforcers.
