The OFT is consulting on ITV's Contract Rights Renewal (CRR) Undertakings which were introduced following the merger of Carlton and Granada in 2003.

The OFT has a duty to review the Undertakings to consider whether there has been a change of circumstances by reason of which the Undertakings might no longer be appropriate in their current form, or at all. If there has been such a change, the OFT may advise the CC that the Undertakings should be varied or replaced, or that the parties should be released from them. This review of the CRR remedy has been carried out with the assistance of Ofcom.
This consultation document invites stakeholders to comment on the available evidence, our analysis and preliminary conclusion on our likely recommendation to the CC.
This consultation document explores a range of possible outcomes from, at one end of the scale, the removal of CRR in its entirety to retaining CRR largely as it is today, and various easements and modifications in between the two extremes.
If the OFT advises the CC that change is appropriate to any part of the Undertakings under review, the choice of outcome is ultimately for the CC. If the CC decides to change the current arrangements, it will consult on its proposals. The CC, however, has no formal powers to gather further supporting evidence and relies largely on the information and evidence provided to it by the OFT. The focus of this consultation is therefore on collecting as much further written evidence as possible to feed into the CC's process.
