The OFT launched a criminal investigation into suspected unlawful mileage adjustment activity in February 2011. In April 2011 Colin Michael Ogle was arrested and the OFT carried out an inspection at the premises of the business run by Mr Ogle, in an operation involving Wiltshire Police and Trading Standards South West Region Enforcement Team.
On 29 November 2011, the OFT brought charges against Mr Ogle in connection with its ongoing investigation into suspected unlawful mileage adjustment.
Mr Ogle appeared at Swindon Magistrates Court on 16 January 2012 and pleaded not guilty in relation to a number of alleged offences under the Consumer Protection from Unfair Trading Regulations 2008 (CPRs) and the Fraud Act 2006.
A case management hearing was held at Swindon Magistrates Court on 30 January 2012 and the trial is now scheduled to take place on 21 - 22 June 2012 at Swindon Magistrates Court.
The OFT published its market study into second hand cars in March 2010, which estimated the potential loss to consumers of illegal car clocking to be up to £580m per year. The market study set out the OFT's belief that legitimate instances of mileage adjustment appear to be rare, and were unlikely to be sufficient to keep in business the 50-plus traders openly offering 'mileage correction services' throughout the UK.
