Update

The Secretary of State has accepted the OFT's recommendation to extend the duration of the Public Transport ticketing Schemes Block Exemption in its current form for an additional period of five years until 29 February 2016. 

An Order extending the Block Exemption on these terms (2011 No.227) will come into force on  28 February 2011. The  order is available at www.legislation.gov.uk.

Summary of review

On 28 July the OFT began a public consultation on its review of the Public Transport Ticketing Schemes Block Exemption (PTTS Block Exemption). The consultation sought views on whether the OFT should make a recommendation to the Secretary of State for Business, Innovation and Skills (the Secretary of State) to extend the duration of the PTTS Block Exemption, which is due to expire in February 2011.

Public transport operators may enter into agreements to offer passengers tickets that they can use on the services of two or more operators. This normally increases the mobility of passengers and makes travel more flexible. The PTTS Block Exemption automatically exempts certain types of ticketing agreements from Chapter I of the Competition Act 1998 (this is the UK law prohibiting anticompetitive agreements) in so far as they meet certain specified conditions. 

The PTTS Block Exemption is due to expire on 28 February 2011. The OFT reviewed it in order to make a recommendation to the Secretary of State on whether the PTTS Block Exemption should continue (whether in the same or in a revised form) or be allowed to lapse, before the current instrument expires.

The OFT has recommended to the Secretary of State that he should extend the duration of the current block exemption for an additional period of five years until 29 February 2016.
