Since 1 May 2004, the OFT along with the courts, has had the power to apply and enforce Articles 81 and 82 in the UK. When doing this, the OFT must follow the case law of the European Court. When applying CA98, section 60 of that Act requires us to ensure that we act consistently with EC law.

The European Competition Network (ECN) has been set up to facilitate close co-operation among national competition authorities (such as the OFT) and the European Commission and to ensure an effective and consistent application of Articles 81 and 82.
Regulation 1/2003 (also known as the Modernisation Regulation) and the Joint Statement of the European Council and the European Commission on the Functioning of the Network of Competition Authorities set out the main principles for the functioning of the ECN.

Competition law is enforced in the UK principally by the OFT. However, in certain industries (communications, gas, electricity, water and sewerage, railway and air traffic services) the sector regulators have been given 'concurrent powers' to apply and enforce CA98 and Articles 81 and 82 of the EC Treaty.
