The OFT has accepted hold separate undertakings given by Guardian Digital Communications Holdings Limited under section 71 of the Enterprise Act 2002. The undertakings are without prejudice to OFT’s ongoing investigation into the completed acquisition by Guardian Digital Communications Limited (a company controlled by Macquarie European Infrastructure Fund II and Macquarie Communications Infrastructure Group) of Airwave Solutions Limited (formerly Airwave O2 Limited). The fact that the OFT has asked for initial undertakings does not rule out its eventual clearance of the merger.
