Unfair contract terms guidance

A range of guidance is available including the OFT's view on certain kinds of unfair terms or terms commonly used by particular trade sectors - these can be downloaded below in pdf format, or ordered from our Publications page ('Guidance on legislation/Unfair terms in consumer contracts').

Unfair contract terms guidance (OFT311)
This is the second issue of the guidance on the Unfair Terms in Consumer Contracts Regulations 1999 and replaces the original issue published in February 2001.

The guidance explains why the OFT considers that certain kinds of standard terms used in contracts with consumers have the potential for unfairness under these Regulations. It represents the OFT's view and explains the basis on which we are likely to take enforcement action.
