(i) Not to worsen for a period of three years from the date of the merger, the terms of supply to any regional or local brewer or independent wholesaler who obtained at least 500 barrels of Carlsberg products from Carlsberg Brewery Ltd in the twelve months preceding 30 September 1992.

(ii) To ensure that no agreement is made which restricts any member of the Allied-Lyons (Allied Domecq) group for more than five years from acquiring beer from persons other than Carlsberg-Tetley.

(iii) For so long as other members of the Allied-Lyons (Allied Domecq) group hold, or hold an interest in, shares conferring 15 per cent or more of its voting rights, not to make or carry out any agreement which either:

(a) prevents for more than three years the owner or occupier of any pub freed from tie by Allied-Lyons (Allied Domecq) in compliance with its undertakings from acquiring beer from whomsoever he may choose; or

(b) prevents such a person for more than one year from acquiring more than 25 per cent of his beer from whomsoever he may choose.
