ORDER ISSUED UNDER SECTION 3 OF THE ACT

1. Acting on the authority of the Office of Fair Trading (the OFT) under paragraph 12 of Schedule 1 to the Enterprise Act 2002, I am satisfied that
 
Astons GB Ltd of 395 Shirley Rd, Southampton, Hampshire SO15 3JD has

i. engaged in a practice which, in relation to estate agency work, has been declared undesirable by the Secretary of State, within the meaning of section 3(1)(d) of the Act;

ii. failed to comply with a requirement imposed by section 9(1) of the Act, within the meaning of  section 3(1)(cb) of the Act;

iii. engaged in estate agency work in relation to residential property in breach of a duty imposed on it by an order under section 23A(1), within the meaning of section 3(1)(ca) of the Act.

2. Taking account of matters at paragraph 1 above, I am satisfied that Astons GB Ltd is unfit to engage in estate agency work. I make an order prohibiting it from doing estate agency work.

3. The order shall not come into operation until any appeal under section 7 of the Act and any further appeal has been determined or the period in which such an appeal may be brought has expired.
