Details of order under section 4 :
1. Being duly authorised by the Chairman of the Office of Fair Trading (the Chairman of the OFT), under paragraph 12 of Schedule 1 to the Enterprise Act 2002, I hereby make an Order under section 4(1) of the Estate Agents Act 1979 (the Act) advising Andrew Rudd that continuation of any of the practices set out in paragraph 2 below will result in my making an Order under section 3(2) of the Act prohibiting him from undertaking any estate agency work as defined in section 1(1) of the Act.
2. The practices referred to in paragraph 1 above are:
(a) the making by an estate agent, knowingly or recklessly and orally or in writing, of any misrepresentation i) as to the existence of, or details relating to, any offer for the interest in land; or ii) as to the existence or status of any prospective purchaser of an interest in land; contrary to paragraph 1, Schedule 3 of The Estate Agents (Undesirable Practices)(No.2) Order 1991 (the 1991 Order).
(b) the failure by an estate agent to forward to his client promptly and in writing accurate details (other than those of a description which the client has indicated in writing he does not wish to receive) of any offer the estate agent has received from a prospective purchaser in respect of an interest in land; contrary to paragraph 2, Schedule 3 of the 1991 Order.
3. The Order shall not come into operation until any appeal under section 7(1) of Act and any further appeal has been determined or the period in which such an appeal may be brought has expired.
