The OFT has brought charges against three women in connection with its ongoing investigation into a suspected unlawful pyramid scheme in the South West of England and Wales.
Tracy Laurence, Rhalina Yuill and Sally Phillips will appear at Bristol Magistrates Court on 9 December 2009 on charges of having established, operated or promoted an unlawful pyramid scheme between May 2008 and January 2009. The charges have been brought under the Consumer Protection from Unfair Trading Regulations 2008 (CPRs).
The wider OFT investigation into the suspected pyramid scheme is continuing.
NOTES
1. Schedule One of the Consumer Protection from Unfair Trading Regulations 2008 (CPRs) prohibits the establishment, operation or promotion of any scheme where money is made primarily from recruiting other people rather than from the sale of goods and services. Breach of the prohibition is an offence under Regulation 12 and is punishable by up to two years imprisonment and/or an unlimited fine.
2. The OFT's investigation is still ongoing and as such no assumption should be made that any person has committed an offence.
3. The CPRs contain a general prohibition against unfair commercial practices and, in particular prohibitions against misleading actions, misleading omissions and aggressive commercial practices. The Regulations are enforceable through the civil and criminal courts.
