OFT welcomes introduction of European Model Leniency Programme

The OFT welcomes the endorsement of the European Competition Network (ECN) Model Leniency Programme in Brussels today.
The Model Leniency Programme was introduced to further enhance the detection and punishment of cross-border cartels, and was approved today by the heads of the competition authorities of the 25 EU Member States and the European Commission. These authorities have given a commitment to align their respective leniency policies to minimum standards set out in the Model Leniency Programme. This will make it easier for companies to report cross-border cartel conduct by bringing about a greater harmonisation of leniency policies across the EU.
The Model Leniency Programme was developed by the ECN Leniency Working Group which was co-chaired by the OFT and the French Conseil de la Concurrence. There are currently 20 different leniency programmes in operation across the EU.
John Fingleton, OFT Chief Executive said:
'The ECN Model Leniency Programme is a good example of effective enforcement policy coordination among European competition authorities. The leading role played by the OFT reflects our commitment to work closely with other competition authorities in the fight against cartels.'
NOTES
1. The OFT has been operating a leniency policy since 2000. Under the policy the OFT offers immunity from fines or significant reductions in fine in return for companies reporting cartel conduct and assisting the OFT with its investigation. The OFT's existing leniency policy and practice are already in line with the ECN Model Leniency Programme and no substantive adjustments are therefore required. 4. The ECN Model Leniency Programme is not legally binding on Member States and does not itself give rise to any legitimate expectations for companies.
